Criticism over NPA’s decision not to prosecute in Cwecwe rape case

Eastern Cape government’s Social Development MEC expressed concern about the matter.

Eastern Cape Social Development MEC Bukiwe Fanta has criticised the National Prosecution Authority’s (NPA) decision to drop charges in the rape case of a eight-year-old girl, Cwecwe.

on Saturday, Fanta voiced strong opposition to the institution’s decision to abandon the case, calling for a reassessment of the matter.

The provincial leader expressed significant concern about the message the issue sends regarding the protection of vulnerable children in South African society.

“The decision not to prosecute sends a troubling message about our commitment to justice for victims of sexual violence, particularly our children.

“We cannot allow such acts to go unpunished, as this undermines the very fabric of our society and the safety of our children,” Fanta said in a statement.

The high-profile case has generated considerable public attention and condemnation across the province and beyond.

It has further raised important questions about the effectiveness of the justice system in protecting minors from abuse.

Call for NPA to review Cwecwe case

Fanta has urged prosecutors to reconsider their position and conduct a comprehensive review of all evidence and circumstances surrounding the case.

“We need to ensure that every child feels safe and supported, and that perpetrators of such heinous crimes are held accountable. It is essential for the healing of the victim and the broader community,” she added.

The Department of Social Development has maintained its involvement in the case, continuing to offer support services to the victim and her family through partnerships with local organisations and child protection agencies.

Fanta emphasised the important role of community vigilance in preventing child abuse, encouraging parents and guardians to remain alert and report suspected cases promptly.

“As a society, we must come together to protect our children and ensure they have the support they need to recover from trauma,” Fanta stated.

The MEC further highlighted the importance of prioritising the Cwecwe’s welfare during the difficult period.

Cwecwe was allegedly raped at her school, Bergview College, in Matatiele, Eastern Cape, in October 2024.

Public anger escalated after the girl’s mother came forward to criticise the slow progress of the investigation.

Although DNA samples were taken from individuals of interest, no foreign DNA was found on the child’s clothing and, therefore, no suspect has been identified.
