Raphael Benza has shared details of a clearance negotiation involving the song “Caiphus Song” by the late rapper Kiernan “AKA” Forbes. The track, which later formed part of AKA’s catalogue, was built around a sample connected to legendary South African musician Caiphus Semenya.
According to Benza, the situation escalated when the publishing representatives for the sampled work issued strict terms. He explained that the initial demand included a substantial upfront fee and full ownership of composition rights, alongside a threat to remove the song if the terms were not met.
Benza stated: “The publishing agent had sent us a $25,000 fee and 100% compositions or an immediate take down.” He added that the timing of the dispute created additional pressure, as the track had already been released and a major music video production was underway for AKA.
Benza further described how he chose to address the issue directly with Caiphus Semenya rather than continuing through formal publishing channels. He arranged a meeting to present the song personally. “I set up a meet up to play the song to Bra Caiphus,” he said. “He really loved the song and especially the name of the song. ‘Caiphus Song’.”
Caiphus Semenya, born in Johannesburg and internationally recognised for his work as a composer and arranger, has contributed to numerous global music projects and has been active in music since the 1950s. His involvement in or association with sampled works often carries significant weight in clearance discussions due to his long-standing catalogue.
Following the meeting, Benza described a shift in negotiations. He stated: “I ‘Managed’ to get us to close with no fee and a super reduced % to Caiphus.” This outcome replaced the initial demand structure that had been issued by the publishing representatives.
The track “Caiphus Song” was officially released on June 2018 as part of AKA’s work and is credited alongside his broader discography, which includes multiple albums and music videos released through various labels. The song itself has been widely circulated across digital platforms and became part of AKA’s visual and musical catalogue during that period.
Benza concluded that the resolution of the clearance process led to a positive relationship outcome. He stated that following the agreement, Kiernan Forbes and Caiphus Semenya developed mutual respect and interaction beyond the business negotiation.
